Hiring for legal Manager with the below experience,
LAP (Loan Against Property) & Title Clearance Lawyer is responsible for conducting legal due diligence of property documents offered as collateral, ensuring clear and marketable title, and mitigating legal risks before loan disbursement. The role involves property document verification, title search, legal opinion drafting, and coordination with internal credit teams.
Key Responsibilities
1. Title Due Diligence
Examine and verify property documents for LAP cases.
Conduct title searches (generally 10–30 years, as per company policy).
Identify encumbrances, charges, litigation, and legal risks.
Review chain of title and ownership history.
2. Legal Documentation Review
Scrutinize:
Sale deeds
Conveyance deeds
Gift deeds
Partition deeds
Lease deeds
Development agreements
Power of Attorney documents
Verify approvals, building plans, and completion/occupancy certificates (if applicable).
3. Encumbrance & Compliance Check
Verify encumbrance certificates from Sub-Registrar records.
Check for mortgage entries, liens, or statutory dues.
Ensure compliance with local property laws and land regulations.
4. Legal Opinion & Reporting
Provide written title clearance reports.
Highlight legal risks and recommend risk mitigation.
Suggest conditions precedent before loan sanction/disbursement.
5. Coordination & Advisory
Work closely with credit, operations, and sales teams.
Liaise with external panel advocates and valuers.
Assist in resolving legal discrepancies in property documents.
6. Litigation & Recovery Support (If Required)
Support SARFAESI or enforcement actions in case of default.
Assist in drafting legal notices related to secured assets.
