Key Responsibilities
🛡️ Data Privacy and Protection
- Policy Development and Implementation:
- Develop, review, and maintain comprehensive Data Privacy Policies, terms of service, and internal procedures to ensure compliance.
- Oversee the implementation of these policies across all business units.
- Risk Assessment and Mitigation:
- Conduct Data Protection Impact Assessments (DPIAs) and privacy risk assessments for new projects, products, and technologies ("Privacy by Design and Default").
- Identify and mitigate risks related to the collection, storage, and processing of personal data.
- Contractual Compliance:
- Draft and review data processing agreements (DPAs), data transfer agreements, and privacy clauses in commercial contracts.
- Incident Management:
- Lead the response efforts in the event of a data breach, including containment, mitigation, and required notification to regulatory authorities and affected individuals.
- Training and Audits:
- Develop and deliver privacy awareness training to employees.
- Monitor compliance with internal privacy standards and facilitate internal or external privacy audits.
💻 TMT (Technology, Media, and Telecommunications) LawThis involves providing legal counsel on the complex regulatory landscape governing technology services, digital content, and communications.
- Technology Contracts:
- Drafting, reviewing, and negotiating a wide range of technology-related contracts, including Master Service Agreements (MSAs), Software as a Service (SaaS) agreements, cloud computing contracts, licensing agreements, and vendor contracts.
- Regulatory Compliance:
- Advising on legal and regulatory issues pertaining to new technologies, such as Artificial Intelligence (AI), blockchain, and e-commerce platforms.
- Ensuring compliance with TMT-specific regulations, including intermediary liability, content moderation rules, and telecommunication licenses.
- Digital and Online Legal Issues:
- Providing legal advice on matters related to cybercrime, IT Act compliance, consumer law for online transactions, and online advertising standards.
💡 IPR (Intellectual Property Rights)Managing and protecting the company's intellectual assets is a critical function.
- IP Strategy and Management:
- Develop and execute an Intellectual Property strategy for the organization, covering patents, trademarks, copyrights, and trade secrets.
- Manage the company's IP portfolio, including filing, prosecution, and maintenance of registrations.
- IP Protection in Contracts:
- Drafting IP-related clauses in contracts, including assignments, licenses, and non-disclosure agreements (NDAs) to safeguard proprietary information.
- Enforcement and Litigation Support:
- Monitor for and advise on potential IP infringement issues (online and offline).
- Support and manage IP-related litigation or dispute resolution efforts.
⚖️ Arbitration and Dispute ResolutionThis expertise is utilized for handling commercial disputes outside of traditional court litigation, often preferred in complex cross-border TMT and IP matters.
- Strategy and Counsel:
- Develop the company’s strategy for both bringing and defending claims in commercial arbitration.
- Advise senior management on the selection of arbitral forums, rules, and jurisdictions.
- Dispute Management:
- Manage the entire arbitration lifecycle, including drafting notices, statements of claim/defense, and managing external counsel (if involved).
- Provide legal support for general commercial litigation and pre-dispute resolution.
- Contractual Clauses:
- Ensure all relevant commercial and technology contracts contain robust and enforceable dispute resolution clauses, primarily focusing on arbitration.
Key Skills and Attributes- Legal Acumen: Expert knowledge across all four specified domains.
- Experience: 4-7 years in inhouse Data Privacy and TMT expert role
- Risk Mitigation: Strong analytical and risk-spotting ability to assess legal exposure and propose pragmatic, implementable solutions.
- Communication: Excellent verbal and written communication skills to articulate complex legal concepts to non-legal business stakeholders.
- Leadership: Ability to lead projects, manage internal teams (if applicable), and coordinate with external counsel.
- Business Partnering: Proactive approach in partnering with business teams (e.g., IT, R&D, Marketing) to integrate compliance into business processes
