Position: Head – Legal (HOD – Legal Department)
Location: Andheri (W), Mumbai
Department: Legal & Compliance
Reporting To: Managing Director / Promoter
Direct Reports: Legal Managers, Litigation Team, Documentation Team, Liaison Team, External Counsels
Role Objective
To lead and manage the entire legal function of the organization, covering litigation, non-litigation, transactional, compliance, redevelopment, land acquisition and regulatory matters.
The role is responsible for safeguarding company assets, enabling project execution, minimizing legal exposure, accelerating approvals and structuring legally secure real estate transactions.
This is a strategic + operational leadership role, not merely advisory.
Key Responsibilities
1. Litigation Management (Civil / Criminal / Revenue / Regulatory)
Ownership: Complete legal risk protection of company projects and land bank
Responsibilities
- Formulate litigation strategy across all forums:
- High Court
- Supreme Court
- City Civil Court
- Small Causes Court
- Co-operative Court
- NCLT
- Consumer Court
- RERA
- SRA Authorities
- Revenue Courts (Collector / Tehsildar / SDO)
- Handle title disputes, possession disputes, tenant disputes, society disputes, development rights disputes, injunctions, specific performance suits
- Coordinate and brief Senior Counsels and Advocates
- Draft written statements, replies, rejoinders, appeals, revisions
- Track court cases, limitation periods and compliance timelines
- Control litigation cost and advocate efficiency
- Provide periodic litigation MIS & risk heat map to management
- Manage police complaints, criminal matters and economic offences where required

- Interpret statutory amendments impacting projects
- Provide legal feasibility opinions before commercial commitments
3. Land Acquisition & Title Due Diligence
Ownership: Acquisition safety

- Conduct title search (minimum 30 years / full chain)

4. SRA, Redevelopment & Society Matters

6. Team Leadership & Department Management
Responsibilities
- Build and lead internal legal team
- Allocate matters based on complexity
- Monitor external counsel performance
- Develop SOPs and legal process manuals
- Maintain document repository & legal trackers
- Train CRM / Sales / Projects teams on legal matters
- Monthly reporting to management
7. Business Partnering (Strategic Role)
The Legal HOD is expected to act as a business enabler — not a blocker.
Responsibilities
- Participate in land negotiation meetings
- Provide deal structuring inputs
- Flag commercial risks early
- Suggest legally viable alternatives
- Support funding and investor documentation
- Assist in dispute settlement negotiations
Candidate Profile
Education
- LLB (Mandatory)
- LLM (Preferred)
- CS qualification (Optional advantage)
Experience
- 12–20+ years in Real Estate Legal
- Mandatory exposure to Mumbai real estate market
- Strong hands-on experience in:
- Land litigation
- SRA projects
- Society redevelopment
- Title due diligence
- High value documentation
