A client has come to you for advice. They are preparing to launch a paid savings app for Gen Z crowd and want you to review their business model before going live.
The app works as follows. On sign-up, users are shown a single permissions screen asking them to allow the app to read their messages and monitor activity across other apps on their device. The screen uses a prominent green "Allow & Continue" button. A small grey link reads "more info" but leads to a 60-page technical document. Users who do not grant permissions cannot use the app.
Using the data collected, the app analyses spending habits and generates a personalised savings recommendation. The recommendation screen displays one option prominently, with a pre-selected "Accept" toggle and a countdown timer. A second option, which costs the user more but earns the provider a referral fee from a partner financial institution, is labelled "Recommended by our experts" and is visually highlighted. Declining requires navigating three additional screens.
The client asks: is there anything here we should be concerned about?
Part 1 (up to 350 words) - Identify the distinct legal issues this business model raises and explain each in brief.
Part 2 (up to 300 words): Choose two issues you consider most significant. Explain them to the client as you would in a memo or email. Reason out a solution that is legally compliant.
Cite any cases, principles, or provisions you rely on.
