Jr. Legal Counsel (Real Estate & PropTech)

Role Overview
PropSafe is seeking a Junior Legal Counsel to architect our legal infrastructure and protect our NRI-focused "Trust-as-a-Service" platform. This role requires a deep command of Indian property laws, contract enforceability, and dispute resolution. You will not only ensure our digital product complies with RBI and DPDP regulations, but you will also serve as the primary legal defender of our property owners—managing everything from title verifications and anti-encroachment strategies to complex vendor negotiations and RERA tribunal representations.
Key Responsibilities
1. Real Estate & Property Law (Core Industry Focus)
Title & Ownership Due Diligence: Design the legal framework for validating property ownership documents (e.g., 7/12 extracts, Index II, Sale Deeds) before properties are listed on the platform, mitigating fraud risks.
Tenancy Law Mastery: Ensure all automated workflows and digital templates strictly comply with the Model Tenancy Act (MTA), the Maharashtra Rent Control Act, and the Transfer of Property Act.
Anti-Encroachment & NRI Protection: Develop legal SOPs and rapid-response mechanisms for unauthorized occupation or encroachment, a critical pain point for absentee NRI landlords.
2. Dispute Resolution & Litigation Management
Mediation & Arbitration: Oversee the legal logic of PropSafe’s internal "Mediator Dashboard." Define the precise legal boundaries between "normal wear and tear" and "deductible damage" for security deposit disputes.
Tribunal Representation: Manage external counsel and represent PropSafe or its clients in matters before RERA authorities, Rent Tribunals, and civil courts.
Eviction & Notice Protocols: Draft and standardize legal notices for rent defaults, breaches of society bylaws, and eviction proceedings.
3. Commercial Contracts & Corporate Law
Bespoke Leave & License Agreements: Oversee the drafting and continual refinement of legally watertight, Maharashtra-compliant e-stamped rental agreements.
Vendor & SaaS Agreements: Lead contract negotiations with critical software development vendors (e.g., Unico Connect) and API partners, ensuring strict adherence to SLAs, IP ownership, and liability caps.
Corporate Governance & IP: Manage Asset Sentinel’s intellectual property portfolio, including the trademarking of "PropSafe," and ensure corporate structuring complies with the Companies Act.
4. PropTech & Regulatory Compliance
FEMA & RBI Frameworks: Provide legal clearance for the flow of funds, ensuring that the platform's escrow logic and split payments comply with RBI Payment Aggregator rules and FEMA regulations for NRI repatriation.
Data Privacy (DPDP Act): Act as the Data Protection Officer, ensuring Aadhaar masking, KYC data residency (India-based servers), and digital "Privacy Waivers" for property inspections are legally sound.
Vicarious Liability Shielding: Draft airtight "Agent Service & Liability Agreements" to protect PropSafe from liability related to the actions of third-party, on-ground brokers.
Qualifications & Required Skills
Education: LLB required; LLM in Corporate or Real Estate Law is highly preferred. Must be registered with the Bar Council of Maharashtra and Goa (or relevant jurisdiction).
Experience: 2–4+ years of active practice or in-house counsel experience, with a heavy emphasis on Indian real estate law, property transactions, and litigation.
Domain Knowledge: Deep expertise in the Model Tenancy Act, RERA, Maharashtra Stamp Act, and FEMA.
Commercial Acumen: Proven experience negotiating complex tech/vendor agreements and a strong understanding of how software (SaaS) and digital signatures (IT Act 2000) intersect with traditional contract law.
Conflict Management: High emotional intelligence with the ability to act as a neutral, decisive legal arbiter in high-stakes financial and property disputes.
