Job Title: Head – Legal (Real Estate)

Role Summary
The Head – Legal will be responsible for leading all legal matters related to the organization’s real estate portfolio, including land acquisition, legal due diligence, regulatory compliance, contract management, litigation, and risk mitigation.
The role requires close collaboration with leadership, projects, sales, CRM, finance, and land acquisition teams to ensure compliant operations and legally secure transactions.
Key Responsibilities
1. Land, Title & Due Diligence
Lead end-to-end legal due diligence for land acquisition, Joint Development Agreements (JDA), Development Agreements (DA), Joint Ventures (JV), and asset purchases.
Verify title chains, encumbrances, right of way (ROW), zoning/land use regulations, and litigation risks.
Structure transactions with risk mitigation mechanisms such as SPVs, escrow arrangements, indemnities, and conditions precedent.
2. Regulatory Compliance
Ensure compliance with Real Estate (Regulation and Development) Act, 2016 (RERA) and applicable local development regulations.
Oversee approvals related to environmental clearances, municipal permissions, CC/OC, and layout sanctions.
Liaise with government authorities and track changes in state real estate laws and policies.
3. Contracts & Documentation
Draft, review, and negotiate key legal documents including:
Joint Development Agreements (JDA)
Development Agreements / Joint Ventures
Sale Deeds and Conveyance Deeds
Lease Agreements
LOIs and MOUs
Contractor and Vendor Agreements
Brokerage Agreements
Customer Documentation
Develop standardized contract templates and approval workflows to reduce legal risk and improve turnaround time.
4. Litigation & Dispute Management
Manage legal disputes involving landowners, vendors, customers, and regulatory authorities.
Coordinate with external legal counsels and oversee litigation strategy, timelines, and legal expenses.
Handle consumer complaints, RERA matters, and legal proceedings effectively.
5. Risk Management & Legal Advisory
Identify potential legal risks in projects and transactions and provide mitigation strategies.
Provide legal opinions and strategic guidance to leadership and board members.
Ensure proper documentation management, record maintenance, and legal audit readiness.
6. Team & Stakeholder Management
Build and lead the in-house legal team while managing external legal advisors.
Conduct training sessions for Sales, Projects, and CRM teams on compliant documentation and legal procedures.
Collaborate with Finance teams on escrow arrangements, securities, and recovery processes.
Qualifications & Experience
LL.B. / LL.M. from a recognized university
Must be enrolled with the State Bar Council
15–18+ years of legal experience in real estate, preferably with a developer or reputed law firm
Strong exposure to land acquisition, RERA compliance, construction contracts, and litigation management
Skills & Competencies
In-depth knowledge of real estate laws and regulatory approvals
Strong commercial negotiation and deal structuring skills
Expertise in litigation management and legal risk assessment
Excellent stakeholder management and leadership skills
