OverviewApna Family is seeking a veteran Trademark Attorney/Consultant with over 30 years of experience to manage our Intellectual Property portfolio on a contractual/retainer basis. We are looking for an expert who has navigated the full spectrum of the Trademark Registry’s procedural challenges.
The RequirementApna Family is looking for a legal heavyweight with deep-rooted expertise in the Indian Intellectual Property landscape. This role is not for generalists; we require a specialist who has spent decades mastering the nuances of the Trademark Act and has an intuitive understanding of the Registry’s evolving practices.
Deep Knowledge Areas RequiredWe expect the consultant to possess authoritative knowledge in:
- Complex Procedural Strategy: Expert handling of the entire litigation lifecycle—from drafting airtight Counter-Statements to filing Evidence in Support of Opposition/Registration (Rule 45/46).
- Substantive Law Mastery: A profound understanding of absolute and relative grounds for refusal, "well-known" mark declarations, and prior-user rights.
- Hearing Excellence: Proven ability to argue cases effectively in Show-Cause Hearings and achieve favorable outcomes in contested matters.
- Case Law Repository: Ability to cite and leverage landmark precedents to overcome difficult Examination Report objections.
- Risk Foresight: Deep insight into multi-class filing strategies to ensure the "Apna Family" brand is protected across all service verticals (Healthcare, Tourism, and Tech).
Key Responsibilities- High-Stakes Drafting: Crafting sophisticated legal responses and affidavits that minimize the risk of abandonment or refusal.
- Opposition Management: Leading the charge in defending our marks or opposing infringing marks with surgical precision.
- Strategic Oversight: Providing "Big Picture" advice on IP protection, licensing, and enforcement.
Qualifications- 30+ Years of Experience: A career dedicated to Trademark and IP law.
- Technical Authority: Exceptional research, analytical, and drafting skills that reflect decades of practice.
- Registered Professional: Must be a registered Trademark Agent or Advocate with a stellar reputation.
