Role:

The Head – Legal will lead the entire legal function of the company, primarily managing litigation, recovery actions, corporate legal matters, portfolio acquisition due diligence, and regulatory compliance for secured and unsecured loan portfolios.

The role will supervise a centralized legal team developing legal strategy, initiating actions, and monitoring litigation across the country and state-level legal managers responsible for on-ground execution of legal proceedings and court matters.

Central Team:

Responsible for strategy, documentation, monitoring, and centralized legal activities.

·  Customer & Legal Notice Management, primarily customer escalations with legal implications and replies to legal notices from borrowers

· Drafting and reviewing corporate agreements, vendor agreements, service contracts, HR, finance, and technology agreements

· Transaction and Investment Legal (assignment agreements, Investment agreements)

· Due Diligence: Legal due diligence for mortgage and non-mortgage loan portfolios & review of title reports, charge creation, and enforceability of security.

· Centralised litigation monitoring: Initiation of legal notices and recovery proceedings and monitoring litigation process and legal operations

. Advocate Panel Management

Local Legal Managers (State Level):

Responsible for execution of legal actions and court coordination at the regional level.

· Litigation Execution: Filing and managing cases in DRT/DRAT, Arbitration forums, Civil Courts, Police authorities, local courts; representation in court hearings; managing documentations and filings

· Execution of legal orders: Supporting execution of court orders, coordinating possession and enforcement actions, assisting in Section 14 implementation, etc.

·   Local stakeholder coordination

Experience:

·  15+ years legal experience

·  ARC / Bank / NBFC legal experience preferred

·  Experience managing secured and unsecured loan recovery litigation

Key Competencies:

·   Litigation management across India

·   SARFAESI and DRT expertise

·   Contract drafting and negotiation

·   Legal risk assessment
